The Appellant appeals against the decision of the Respondent dated 3 February 2026 to refuse his application for a third driving instructor trainee licence.
The Respondent made application by way of Form GRC5 dated 24 March 2026, copied to the Appellant, to have this appeal struck out pursuant to Regulation 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (‘the Rules’) as having no reasonable prospect of success since, pursuant to Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005, as the Appellant had failed his third, and maximum permitted, attempt to pass his Part 3 test on 20 March 2026, that provides that a trainee licence remains in force only until the day immediately following the Appellant’s third unsuccessful attempt to pass his Part 3 test.
The Appellant is no longer entitled to undertake a Part 3 test; a trainee licence being issued only to aid an aspiring Approved Driving Instructor to pass his Part 3 test.
This appeal is struck out as having no reasonable prospect of success.
