Upon the parties attending the hearing and having agreed that the appeal should be allowed.

And upon it appearing to the Tribunal that that the making of a consent order disposing of the proceedings in the terms agreed is the appropriate course and the Tribunal approving the consent order pursuant to Rule 37(1).

BY CONSENT IT IS ORDERED THAT

1.

The Commissioner’s Decision Notice dated 19 August 2025, reference: IC-389759-T1Y9 is substituted in the following terms:

a.

Oxfordshire County Council is entitled to rely upon regulation 12(5)(e) of the EIR so as to refuse to provide the information requested on 28 April 2024 set out in the Schedule to this Order; and

b.

the Commissioner does not require Oxfordshire County Council to take any further steps in response to the request.

2.

Pursuant to rule 14(6) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, the Schedule to the consent order is to be kept confidential, disclosed only to the Appellant and Respondent and not disclosed to any member of the public.

3.

There be no order as to costs.

4.

This order brings the proceedings to a close
